2. SERVICE DESCRIPTION
SynaptOm provides a neuroscience-driven digital platform that delivers educational content, cognitive training modules, and performance enhancement programs based on applied neuroscience and neuroplasticity principles.
The Service includes:

- Neuroscience-based performance and wellness interventions (including NeuroCyte)
- Cognitive, behavioral, and lifestyle optimization tools
- Personalized insights, tracking, and analytics
These offerings are developed based on emerging scientific research in neuroscience and human performance, and may evolve over time as part of ongoing research and development.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We reserve the right to modify or discontinue any part of the Service at any time.
3. USER ELIGIBILITY
3.1 Age Requirement

The Synaptom name, logo, and all related trademarks and service marks are the exclusive property of Synaptom Private Limited. You may not use these marks without our express written consent.
Users shall not copy, replicate, reverse engineer, distribute, or create derivative works based on any methodologies, frameworks, exercises, or program structures provided by SynaptOm, whether accessed digitally or through guided sessions.
7. PAYMENT TERMS
7.1 Subscription Fees
If you opt for premium courses or features, you agree to pay the subscription fees displayed at the time of purchase. All fees are exclusive of applicable taxes, which will be added to your invoice as required by law.
7.2 Billing and Payment
We accept payments through authorized payment gateways. Your payment information will be processed securely in accordance with our Privacy Policy. You authorize us to charge your payment method for all fees due.
7.3 Refund Policy
Refunds for course enrollments will be issued in accordance with our Refund Policy, which is available on the Service. Requests for refunds must be submitted within the specified timeframe. Digital content is non-refundable once accessed or downloaded.
7.4 Automatic Renewal
If you subscribe to a recurring subscription, your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
8.2 Health & Program Disclaimer (UPDATED)
The Service includes neuroscience-based wellness and performance enhancement programs designed to support cognitive, behavioral, and lifestyle improvements. These programs are not intended to constitute medical treatment, diagnosis, or clinical care.
While the protocols are developed based on scientific principles, users are advised to follow all guidance as provided within the program. Any deviation, misuse, or unsupervised application may lead to unintended outcomes, for which the Company shall not be responsible.
Users should consult qualified healthcare professionals for any medical concerns. Use of the Service does not establish any doctor-patient, therapist-client, or healthcare provider relationship.
8.3 No Guarantee of Results
The Company does not guarantee specific outcomes or results from the use of the Service. Outcomes may vary based on individual participation, adherence to protocols, environmental factors, and other variables beyond the Company's control.

THE MAXIMUM LIABILITY OF SYNAPTOM FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR INR 1,000 (Indian Rupees One Thousand), WHICHEVER IS GREATER.
THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF THE ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
THESE LIMITATIONS APPLY REGARDLESS OF THE NATURE OF THE CLAIM, WHETHER ARISING IN CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE.
10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Synaptom Private Limited, its directors, officers, employees, agents, and successors from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your violation of these Terms of Service
- Your violation of any applicable law or regulation
- Your misuse of the Service
- Your infringement of any intellectual property or other rights of third parties
- Any User Content you submit or post through the Service
This includes, without limitation, claims arising from misuse of the Service, deviation from prescribed protocols, or reliance on health-related or performance-related information provided through the Service.
11. USE OF PROGRAMS AND PROTOCOLS
Users agree to strictly follow all instructions, guidelines, and protocols provided as part of the Service. The methodologies and exercises are designed to be delivered in a structured and guided manner.
Any modification, unauthorized adaptation, independent experimentation, or use outside the intended framework is undertaken at the user's own risk. SynaptOm shall not be liable for any consequences arising from improper use, misuse, or non-adherence to program protocols.

14.2 Termination by Company
Synaptom reserves the right to suspend or terminate your account and access to the Service immediately and without notice if:
- You violate any provision of these Terms
- You engage in fraudulent, illegal, or harmful conduct
- Your account is associated with suspicious or malicious activities
- We determine, at our sole discretion, that termination is necessary for the security or integrity of the Service
14.3 Effect of Termination

16.3 Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of India, specifically the laws of Kerala, without regard to its conflicts of law provisions. The courts in Kochi, Kerala, shall have exclusive jurisdiction over any disputes arising from or related to these Terms.
17. REGULATORY COMPLIANCE
The Service and these Terms comply with applicable Indian laws and international standards, including but not limited to:

- Digital Personal Data Protection Act, 2023
- Clinical Establishments (Registration and Regulation) Act, 2010

18. SEVERABILITY
